How is it possible that two companies can protect the same trademark?

A trademark is an exclusive right on a sign when registered. The rights will be acquired for certain goods and/or services. In principle it is possible to protect your trademark for all possible goods and services. The goods and services are grouped in classes.This would mean a trademark application for 45 classes and in practise this hardly happens. Even if your trademark would be protected in 45 classes then you need to use it for al those products and services otherwise you would loose the right for the products and services for which it is not used.

It thus could happen that two parties request protection for the same trademark but for different goods and services. As long as there is no likelihood of confusion on the part of the public there is no problem!
